Conditional discharge for teen who swore at police

Burgess had been release from prison just a week before

A Douglas teenager who abused police after calling them because she was trapped in roadworks had been released from prison a week earlier, a court’s heard.

Eighteen-year-old Rosemary Burgess of Clifton Terrace appeared before magistrates at Douglas courthouse via a video link.

She pleaded guilty to disorderly behaviour at 5.45am on Loch Promenade in Douglas on 27 May.

Prosecution advocate Rebecca Cubbon said Burgess called police saying she was stuck behind roadwork fencing on Douglas Promenade.

When police freed her, they searched her, suspecting she was carrying drugs – and Burgess became extremely abusive.

The court heard she’d left prison on 21 May after serving a jail term for producing cannabis, possessing the class B drug, criminal damage to a shop, using provoking behaviour, stealing a mountain bike and breaching lockdown rules.

Her advocate said Burgess commonly swore, and used the F-word ‘as a matter of course’, including towards people she loved.

Magistrates said the incident had been unpleasant but minor, and handed Burgess a conditional discharge for 12 months.
