Tynwald commissioner 'disappointed' by lack of compensation power

Angela Main Thompson says current situation is "unsatisfactory"

The Tynwald Commissioner for Administration says it's disappointing that there are no plans to update laws allowing compensation to be paid to those impacted by government maladministration.

Angela Main Thompson made the remarks following a recent report into a planning issue.

Ms Main Thompson recently recorded a finding of maladministration against the Cabinet Office after a mapping error.

In her report she highlighted that in other jurisdictions she'd be able to recommend compensation be awarded to those affected by the mistake but in the Isle of Man this isn't an option.

An addendum to that report has now been published in which the Tynwald Commissioner says it's "unsatisfactory" not to have that power.

In her update she says it may have been an oversight or failure to analyse the different constitutional basis for government departments on the Isle of Man.

She says it's her understanding that a bill to amend the current legislation was due to be included in the legislative programme, for the 2023-24 parliamentary year, but this doesn't appear in the current version of the Island Plan.

Ms Main Thompson has described the omission as "disappointing" particularly as the topic was first raised by her predecessor in 2018.
