Police failed to check with AG's office before pursuing affray case
A man’s walked free from court after police failed to consult with the Attorney General’s chambers about charging a man with affray.
Forty-year-old Kevin Cain, of Reayrt Ny Cashtal in Castletown, appeared before High Bailiff Jayne Hughes at Douglas courthouse.
The affray charge dating to 3 November was withdrawn by the prosecution, after advocate Barry Swain said officers hadn’t checked before charging him with the offence.
He said Mr Cain should never have appeared in court, and apologised on behalf of the Crown.
Mrs Hughes said she was concerned about the number of times charges were being brought unnecessarily by police, and said she’d be raising the issue with the public prosecutions office.
