39-year-old 'totally misread' situation
A Douglas man who punched someone in the face in an ‘unprovoked’ assault has avoided being sent to prison.
Andrew Yan Hong Cheung, of Belmont Terrace, attacked the man on 16 July last year at a house in the capital.
The 39-year-old later pleaded guilty to assault causing actual bodily harm.
During sentencing at Douglas Courthouse (10 March) Cheung’s advocate told the court his client needed to work on his ‘problem solving mechanisms’ adding: "He has totally misread the situation."
Imposing a six-month custodial sentence, suspended for two years, Deputy High Bailiff Rachel Braidwood said the offence had been aggravated by the presence of children in the property.
“This was a serious incident. You were clearly triggered into using violence against him.”
A two-year suspended sentence supervision order has also been implemented; Cheung must pay £125 in prosecution costs and £1,000 in compensation.
