Former gov't department admits data protection offence

DED taken to court

A former government department has admitted breaching data protection laws.

What was the Department of Economic Development - now the Department for Enterprise - was recently taken to the civil court by an Island resident.

The case began last year, when Richard Christian made a 'subject access request' to the DED.

He was exercising a legal right to have public bodies disclose all the information they hold on record about you within six weeks.

But the DED was almost six weeks late, and the information returned was incomplete - offences it admitted responsibility for.

Representing himself in court, Mr Christian said the affair had caused distress, aggravating a previously-held mental health condition and causing him to lose income from his business - complaints which were rejected by the judge.

He went on to argue the actions were a 'deliberate plan' calculated for the Department's 'own ends'.

However Deemster Sharon Roberts ruled this was not a matter for the case at hand, and dismissed his claims for £5,000 compensation against the DED.
