MHK's react to UK Government's Assisted Dying Bill recommendation

MHK's have been reacting to the UK Government's recommendation on the Isle of Man's Assisted Dying Bill.

This week, the UK Ministry of Justice confirmed that it's currently unable to recommend the Bill for Royal Assent at this time.

Onchan MHK Rob Callister and Ramsey MHK Lawrie Hooper both took to social media to question the UK's involvement in the bill.

Mr Callister says it is 'very rare for the UK Government to withhold Royal Assent from Crown Dependency legislation. 

Meanwhile, Mr Hooper had stronger words as he believes the 'step raises serious constitutional concerns'. 

He goes on to say the Isle of Man is 'not a colony of the UK'.

 

 

Speaking in agreement with the UK, Arbory, Castletown and Malew MHK Tim Glover, who also posted on social media, says he 'fought hard for better legislation'.

Mr Glover adds 'These safeguards identified were all brought up at the time but those in favour had dug their heels in by then.'

 

The UK Ministry of Justice had sought clarity on the arrangements for monitoring assisted deaths, safeguards against coercion and ensuring individuals have capacity to make decisions.

It says that while the Manx government provided comprehensive assurances and commitments that would mitigate the legal risk significantly, they do not form part of the bill.

As a result, it's the UK Government's view that these matters must be addressed in order for the bill to comply with the European Convention on Human Rights.

While the Ministry is unable to recommend the bill for Royal Assent at this time, it says this should not be interpreted as disallowing Royal Assent, but that it reflects the need to ensure the legislation contains the necessary protections.
